Project Status

On August 10, 2023, the Newberg Planning Commission approved a Major Modification to CUP-2-90 with a Design Review and Parking Determination (MISC123-0009) for a shelter at 615N College Street, tax lot R3218DD 02900, subject to the conditions listed in the attached Order. The Commission’s decision will become effective on August 25, 2023, unless an appeal is filed.

Project Information

The Hearing on this case has been continued to June 22, 2023 at 7 pm at the Public Safety Building. The Applicant has requested that the hearing be continued again to August 10, 2023 at 7 pm at the Public Safety Building.

A property owner in your neighborhood, Yamhill Community Action Partnership (YCAP),  submitted an application to the City of Newberg to modify an existing conditional use approval to expand the existing shelter facility located at 615 N College Street.  The current proposal is it to make minor renovations to the facility to increase bed capacity by 8 beds, for a total capacity of 24 beds. To accommodate these extra beds and improve ADA accessibility, interior changes will be made to the existing home. Additionally, a new approximately 2,500 square foot (sq ft) modular structure will be added on the west side of the site to move all administration and office functions out of the house, and to expand the services provided to clients and increase on site support. The modular structure will provide two private consultation rooms and a meeting room that can be used for counseling, case management, clinical appointments, etc. and will be utilized by staff, community partners, and volunteers.

This application also includes a request for the Director's determination to be made on the parking space requirements for buildings and uses not identified in the Newberg Municipal Code.

This application is for a major modification to the original Type III Conditional Use permit approved in 1990.  Modifications to Type III Conditional Use Permits shall be heard and decided by the Planning Commission through a quasi-judicial hearing per NMC 15.100.050(H). The decision shall be made after public notice and a public hearing is held in accordance with the requirements of NMC 15.100.090 et seq. A Type III decision may be appealed to the city council by a Type III affected party in accordance with NMC 15.100.160 et seq.

We invite you to participate in the continued land use hearing scheduled before the Planning Commission on Thursday, August 10, 2023 at 7:00pm at Newberg Public Safety Building, 401 E Third Street . If you wish to participate in the hearing, you may do so in person or be represented by someone else. Oral testimony typically is limited to five minutes per speaker.

All written comments must be turned in by noon on  Monday, June, 5, 2023.  Written information received after this time will be read out loud at the hearing subject to time limits for speakers, and will be included in the record if there are further proceedings.

Any issue which might be raised in an appeal of this case to the Land Use Board of Appeals (LUBA) must be raised during the public hearing process.  You must include enough detail to enable the decision maker an opportunity to respond.  The applicable criteria used to make a decision on this application are the following:

Prior to the conclusion of the initial evidentiary hearing, any participant may request an opportunity to present additional evidence, arguments or testimony regarding the application through a continuance or extension of the record.  Failure of an issue to be raised in the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the State Land Use Board of Appeals based on that issue.

If you participate in the public hearing process, either by testifying at the public hearing, or by sending in written comments, you will be sent information about any decision made by the City relating to this project.
