Rendering of Subdivision

A property owner in your neighborhood submitted an application to the City of Newberg for modifications to the Springbrook Master Plan for the area west of Hess Creek; a zone change to convert a Springbrook District/Neighborhood Commercial (SD/NC) area to Springbrook District/Mid-Rise Residential (SD/MRR) for 11 acres at the southeast corner of N College Street/E Mountainview Drive; and an 8-phase, ±386-lot subdivision with ±403 homes, open space, pedestrian bridge, and preserved habitat along Hess Creek. The subdivision portion of the application will be for preliminary subdivision plat approval.

 

The applications will be reviewed by the Planning Commission at a public hearing and their recommendations forwarded to the City Council for a separate public hearing and decisions.  The recommendations shall be made after public notice and a public hearing is held in accordance with the requirements of NMC 15.100.050. The Commission will review modifications to the Springbrook Master Plan, Zone Change, Subdivision and Stream Corridor.

A final copy of staff findings will be available 7 days prior to the public hearing date. 

 

All written comments must be turned in by Noon on Monday, April 10, 2023.  Written information received after this time will be read out loud at the hearing subject to time limits for speakers, and will be included in the record if there are further proceedings.

 

Any issue which might be raised in an appeal of this case to the Land Use Board of Appeals (LUBA) must be submitted to the City in writing before this date.  You must include enough detail to enable the decision maker an opportunity to respond.  The applicable criteria used to make a decision on the applications is: Master Plan - Newberg Municipal Code 15.326; Zone Change - Newberg Municipal Code 5.302, and Statewide Planning Goals and Newberg Comprehensive Plan; Preliminary Subdivision Plat Newberg Municipal Code 15.200, 15.405, 15.410, 15.415, 15.420, 15.425, 15.430, 15.440, 15.505, 15.342.

Prior to the conclusion of the initial evidentiary hearing, any participant may request an opportunity to present additional evidence, arguments or testimony regarding the application through a continuance or extension of the record.  Failure of an issue to be raised in the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the State Land Use Board of Appeals based on that issue.

If you participate in the public hearing process, either by testifying at the public hearing, or by sending in written comments, you will be sent information about any decision made by the City relating to this project.

Additional information and updates such as public hearing schedules and other project information will be posted as evaluation of the project advances.

STATUS: Applications have been approved with conditions (Adopted Order 2023-44 & Ordinance 2023-2915 Adopted 7-3-23 - see file at end of page).

PUBLIC COMMENT PERIOD: Planning Commission comment period began March 23, 2023, any comments received by April 5, 2023 will be incorporated into the staff report. Comments received after April 5, 2023 will be forwarded to the Planning Commission to be included as part of the public record.

City Council comment period began on June 13, 2023, any comments received by June 22, 2023 will be incorporated into the staff report. Comments received after June 22, 2023 will be forwarded to the City Council to be included as part of the public record.
