On June 8, 2023, the Newberg Planning Commission approved the request for a major modification of a previously approved Planned Unit Development (PUD18-0001) and Conditional Use Permit (CUP18-0004) to construct 196 multi-family dwelling units in eight multi-family structures at Highway 99W and E Crestview Drive, tax lot R3216AC 13800, subject to the conditions listed in the attached Planning Commission Order. The Planning Commission’s decision will become effective on June 23, 2023, unless an appeal is filed.

An affected party may appeal the Commission’s decision to the City Council within 14 calendar days of the Commission’s written decision in accordance with Newberg Development Code §15.100.170. Affected parties include the applicant, any party entitled to receive notice of the hearing, anyone providing written or oral comments at the hearing, and anyone providing written comments prior to the close of the hearing. All appeals must be in writing on a form provided by the Planning Division. Anyone wishing to appeal must submit the written appeal form together with the required fee of $1,165 plus the 5% Technology Fee to the Planning Division.

The deadline for filing an appeal is 4:30 pm on June 22, 2023.

Any issue which might be raised in an appeal of this case to the Land Use Board of Appeals (LUBA) must be raised during the public hearing process.  You must include enough detail to enable the decision maker an opportunity to respond.  The applicable criteria used to make a decision on this application for a major modification to a previously approved Planned Unit Development (PUD) and Conditional Use Permit (CUP) are found in Newberg Development Code Chapter 15.220, Chapter 15.225, Chapter 15.240, and Division 15.400.

Prior to the conclusion of the initial evidentiary hearing, any participant may request an opportunity to present additional evidence, arguments or testimony regarding the application through a continuance or extension of the record.  Failure of an issue to be raised in the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the State Land Use Board of Appeals based on that issue.

The Planning Commission will make a decision at the end of the public hearing process.  If you participate in the public hearing process, either by testifying at the public hearing, or by sending in written comments, we will send you information about any decision made by the City relating to this project.

Applicant Project Statement: The applicant is proposing a major modification to Phase 2 of the Crestivew Crossing PUD (PUD18-0001) and CUP (CUP18-0004) to provide 196 multi-family apartment units in place of the previously approved 110 small-lot single-family detached homes. The proposed development would increase the total number of units in the PUD from 299 to 386 units. The proposed multi-family development includes a mix of unit types provided in eight (8) garden-style apartment buildings and community recreation facility for use by the residents.

The Crestview Crossing Community was designed with a network of active and passive open space areas for use by the community. The planned development includes a network of open spaces and wetlands, a thoughtfully linked pedestrian circulation system, and several pedestrian amenities. In addition to the existing open space areas in the planned development, the proposed multi-family development will include a community recreation facility which will provide an indoor sports court, picnic tables and lawn recreation space. Pedestrian facilities will provide connection between Phase 2 and other phases of the PUD, as well as Spring Meadow Park to the west .
