The City of Newberg is proposing to amend its Comprehensive Plan and Development Code that is related to clear and objective Multifamily Design Standards.

 

 

 

Why does the Comprehensive Plan & Development Code need to be amended?

The Fair Housing Council of Oregon identified that the City of Newberg Development Code is not in compliance with the needed housing requirements of Oregon Revised Statutes (ORS) 197.286, ORS 197.296–197.314, ORS 197.303 and ORS 197.307(4) to have clear and objective standards of Multifamily housing consisting of 5+ units.

Background:

Under the Newberg City Council Direction City staff submitted for a grant in September 2021 to “Promote provision of affordable and workforce housing.” The grant was to audit the Newberg Comprehensive Plan and Newberg Development Code and update necessary goals, polices and development code standards to ensure Newberg’s housing goals and polices, and development regulations are clear and objective for needed housing.

A Citizens Advisory Committee (CAC) met from June 2022 through December 2022 providing guidance and feedback to the project consultant 3J Consulting. Input was also gathered though an open house and an online survey.  The proposed changes are a culmination of the CAC and consultants work in identifying what policies need to be modified in the Comprehensive Plan under Housing and Urban Design and in the Development Code.

What do the amendments affect?

Future projects that are Multifamily that consist of 5 and more units.

The next steps:

A Comprehensive Plan and municipal code amendment is a Type IV application and follows the procedures in Newberg Municipal Code15.100.060.  
The Planning Commission will hold a legislative public hearing for Resolution No. 2022-386 and City Council Ordinance No. 2023-2913 .  The Commission will make a recommendation to the Newberg City Council. Following the Planning Commission’s recommendation, the Newberg City Council will hold a legislative public hearing to consider the matter.

Any issue which might be raised in an appeal of this case to the Land Use Board of Appeals (LUBA) must be raised during the public hearing process. You must include enough detail to enable the decision maker an opportunity to respond. The applicable criteria used to make a decision on this application for a comprehensive Plan amendment are found in Newberg Development Code Section 15.100.060.

Prior to the conclusion of the initial evidentiary hearing, any participant may request an opportunity to present additional evidence, arguments or testimony regarding the application through a continuance or extension of the record. Failure of an issue to be raised in the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the State Land Use Board of Appeals based on that issue.

If you participate in the public hearing process, either by testifying at the public hearing, or by sending in written comments, you will be sent information about any decision made by the City relating to this project.
