POLICE PUBLIC RECORDS REQUEST
The Newberg-Dundee Police Department will respond to all public records requests within five (5) business days of receipt or will notify the requester if additional time is needed to complete the response. If fulfillment of the request is expected to exceed ten (10) business days, written notification will be provided.
If a request is denied, the requester will receive a written notice within ten (10) business days that cites the specific reason(s) for the denial. The requester has the right to appeal a denial through the Yamhill County District Attorney’s Office.
Under Oregon Public Records Law, records related to active investigations or criminal cases pending court proceedings are not subject to release. Requests for discovery must be submitted directly to the appropriate court.
Requests involving child abuse cases will be referred to the Department of Human Services (DHS) when the case falls under the definition of child abuse as provided in ORS 419B.005.
- Can only be conducted for the Applicant and their Spouse/Domestic Partner residing at the same address.
- Can only be conducted for citizens who reside within Newberg-Dundee Police Department’s law enforcement jurisdiction and for the requesting party.
- A certified letter will state whether you have a criminal record within the cities of Newberg or Dundee. This certified letter may be used when applying for a work or a travel visa.
- Citizens outside the city limits of Newberg or Dundee must contact Yamhill County Sheriff’s Department.
Oregon law provides numerous exemptions to the disclosure of public records. Even when records are eligible for release, certain information may be redacted, most commonly to protect personal privacy or other legally protected information. The following types of records are generally exempt from disclosure under Oregon law:
- Medical information – ORS 192.255(2)
- Active police investigations – ORS 192.345(3)
Note: Limited arrest information may be releasable in some cases. - Employee personnel and internal investigation records – ORS 192.345(12); ORS 181A.674
- Concealed Handgun License information – ORS 192.374
This includes whether an individual does or does not hold a license. - Booking photographs (mugshots) – ORS 133.870
Not releasable until a conviction occurs. - Juvenile records – ORS 419A.255
Certain arrest information may be available through the Juvenile Department. - Autopsy reports – ORS 192.345(36)
- Child abuse or elder abuse reports – ORS 419B.035; ORS 124.090
- Law enforcement drone video – ORS 837.310
- Social Security numbers – ORS 192.345(28)
