UPDATE: The Planning Commission held a hearing on this application on May 14, 2015 and took public testimony. They closed public testimony, and continued the hearing to June 11, 2015. On June 11 the Planning Commission deliberated, and approved Resolution 2015-307, which recommended that the City Council approve the zone change/comprehensive plan map change application. The City Council held a hearing on this application on July 6, 2015, took public testimony, deliberated, and approved the application by adopting Order 2015-0037.

MARTELL COMMONS APPLICATION: NOTICE OF CITY COUNCIL HEARING ON A COMPREHENSIVE PLAN MAP CHANGE FROM LDR TO HDR, AND ZONING MAP CHANGE FROM R-1 TO R-3

A property owner submitted an application to the City of Newberg for a comprehensive plan map change from Low Density Residential/LDR to High Density Residential/HDR and zone change from R-1 to R-3. The Newberg City Council will hold a hearing on July 6, 2015 at 7 pm at the Newberg Public Safety Building, 401 E. Third Street, Newberg, OR, to evaluate the proposal.  You are invited to take part in the City's review of this project by sending in your written comments or testifying before the City Council.  For more details about giving comments, please see below.

The application would change the Comprehensive Plan Designation from Low Density Residential to High Density Residential, and change the zone from R-1 to R-3.

Existing: R-1 Low Density Residential District: The purpose of this land use designation is to provide for low density urban single-family residential uses at an average overall density of 4.4 units per gross buildable acre in the district.
Proposed: R-3 High Density Residential District: The purpose of this land use designation is to provide multifamily dwellings of different types and styles at an average overall density of 16.5 units per gross buildable acre in the district. Density may vary depending on lot size, off-street parking area, transportation, landscaping and other site considerations.

The applicable criteria used to make a decision on this application for a comprehensive plan map amendment/zoning map amendment are found in Newberg Development Code section 15.302.030(A)3.

If this application is approved then the comprehensive plan and zoning designations would change but no development would be approved. The applicant would need to apply for design review approval before the site can be developed.

The City Council asks that written testimony be submitted to the City Recorder before 4:30 p.m. on July 1, 2015.  Written information received after this time will be brought before the Council on the night of the hearing.

Any issue which might be raised in an appeal of this case to the Land Use Board of Appeals (LUBA) must be raised during the public hearing process.  You must include enough detail to enable the decision maker an opportunity to respond.  The applicable criteria used to make a decision on this application for a comprehensive plan map and zone change are found in Newberg Development Code Section 15.302.030(A)3.

Failure of an issue to be raised in the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the State Land Use Board of Appeals based on that issue.

The City Council will make a decision on the application at the end of the public hearing process. If you participate in the public hearing process, either by testifying at the public hearing, or by sending in written comments, we will send you information about any decision made by the City relating to this project.
